Analysis of the Fulfillment of Gambling Crime Elements in the Online Gambling Game “Pragmatic Play”

Abstract
The advancement of technology has created a new realm known as cyberspace, which enables the emergence of various forms of cybercrime, including online gambling found on the “Pragmatic Play” platform. In law enforcement, authorities more frequently rely on the KUHP rather than the UU ITE to prosecute online gambling offenders, despite the crime clearly occurring within cyberspace. This is evident in Decision No. 1426/Pid.B/2024/PN Sby. This study aims to demonstrate that the decision would be more appropriate if UU ITE were applied. Using normative legal research, the case facts are matched with the offense elements under UU ITE.
